Der Stein des Anstosses
Am Sonntag den 1.10.2007 wurde ich von einem Herrn J. im Hotel abgeholt. Er brachte mich zum Flughafen und verabschiedete sich, bevor ich einchecken konnte. Am Schalter bekam ich zum Glück die Unterstützung von Frau M. I., die die Studiosus-Reise (Reise durch Ecuador und Galapagos) geführt hatte.
Ich erfuhr, dass alle Reisenden von Ekuador nach Brasilien die Gelbfieberimpfung ausweisen müssen. Aus brasilianischer Sicht ist Ekuador ein Gelbfiebergebiet:
> Die Impfung muss mindestens 10 Tage alt sein (Grund: Inkubationszeit).
> Photokopien vom Impfausweis werden in Brasilien nicht akzeptiert.
Meine Gelbfieberimpfung wäre gültig (Am 20.1.2000 durchgeführt und 10 Jahre gültig), aber ich habe den Ausweis nicht mitgenommen. In den Reiseunterlagen wird diese brasilianische Regelung nicht erwähnt. Von der Familie S., die nach Peru weiterreiste (ebenfalls mit Studiosus) erfuhr ich, dass sie schriftlich auf eine ähnliche Regelungen zwischen Ekuador und Peru aufmerksam gemacht wurde.
Die Lösungsansätze
Dennoch versuchten Frau M. I. und ich Möglichkeiten zu finden, damit ich spätestens am nächsten Tag nach Manaus fliegen könnte (via Rio und/oder Sao Paolo). Dafür hätte Ich die Gelbfieberimpfung am Montag erhalten müssen und gleichzeitig eine illegale Rückdatierung beantragen müssen. Nach einem Gespräch zwischen Herrn A. O. vom Notruftelefon Marco Polo Reisen in München und Frau A. C. C. von South American Tours in Quito ergab sich folgende Situation:
> Herr A. O. gibt zu verstehen, dass Marco Polo Reisen den Fehler begangen hat. Er gibt weiter zu verstehen, dass die Reisekosten zurückerstattet werden.
> Er empfiehlt den nächsten Flug nach Europa zu buchen, welcher ebenfalls zurückerstattet werden soll.
> Die Idee einer Impfung mit Rückdatierung schien mir zu riskant, weil sie gesetzwidrig gewesen wäre.
Die Entscheidung
Am Sonntagnachmittag 15:00 Uhr (die Iberia-Büros waren bis dann geschlossen) konnte ich mit der Hilfe von Frau M. I. eine Rückreise Guayaquil – Madrid – Zürich in der Business-Class buchen (In der Economy-Class waren alle Plätze bereits reserviert).
Mit der Mitarbeiterin von Iberia suchten wir die günstigste Variante:
> Guayaquil – Madrid in Business-Class und Madrid – Zürich in Economy-Class (mit Penalty im Zusammenhang mit der Umbuchung).
> Guayaquil – Madrid – Zürich in Business-Class Die 2. Variante mit einem Preis von 2’034 Dollar erwies sich als die günstigere und ich buchte den Flug in Business-Class.
Meine Erwartungen
Der Abbruch dieser Reise ist auf eine ungenügende Information seitens Marco Polo Reisen zurückzuführen. Von professionellen Gesellschaften wie Studiosus und Marco Polo Reisen erwarte ich umfangreiche und vollständige Dienstleistungen (inkl. Unterlagen), welche angesichts der stolzen Reisepreisen sebstverständlich dabei sein müssten.
Meine Forderungen an Marco Polo Reisen:
> Rückerstattung der Reise: 2'529 €
> Rückerstattung der Rückreisekosten: 2'034 $
> Ich verzichte auf die Rückerstattung der Reisekosten zwischen Guayaquil – Panama City – Manaus.

Begründung (Original):
Unsere Versicherungsnehmerin bedauert noch einmal ausserordentlich, dass Sie den Brasilienteil Ihrer Reise nicht wahrnehmen konnten, da Sie Ihren Impfpass nicht mitgeführt haben.
Wir müssen gleichwohl entgegen halten, dass unsere Versicherungsnehmerin in den Reiseinformationen auf die Notwendigkeit einer Gelbfieberimpfung für weite Teile Brasiliens hinweist und weiter ausführt, dass dies gelegentlich auch bei der Weiterreise z.B. in das Amazonasgebiet kontrolliert wird.
Sie haben dies schliesslich auch beachtet und sich impfen lassen. Aber den einzigen Nachweis darüber, nämlich den Impfpass, nicht mit sich zu führen, ist für uns absolut nicht nachvollziehbar.
Meine Kommentare dazu:
Marco Polo Reisen hat den Fall an der TAS weitergeleitet und entsprechend de facto nachgegeben, dass diese Angaben gefehlt haben.
Beinahe 5 Monate haben die beiden Gesellschaften gebraucht und dies festzustellen. Wieso hat Marco Polo diese sogenannten Fakten nicht selber ins Feld geführt?
In diesem Schreiben geht eindeutig daraus hervor, dass die Sachlage zwischen Ecuador und Brasilien immer noch nicht erfasst worden ist (Zitat: "Wir müssen gleichwohl entgegen halten, dass unsere Versicherungsnehmerin in den Reiseinformationen auf die Notwendigkeit einer Gelbfieberimpfung für weite Teile Brasiliens hinweist und weiter ausführt, dass dies gelegentlich auch bei der Weiterreise z.B. in das Amazonasgebiet kontrolliert wird."). Es handelt sich um brasilianische Gesetze und nicht um gelegentliche Kontrollen.
Ich habe mich nicht impfen lassen, ich war bereits geimpft (Am 20.01.2000 durchgeführt und 10 Jahre gültig).
Die Mitarbeiter von Marco Polo Reisen und besonders der Mitarbeiter von TAS haben unseriös, dilettantisch und unprofessionell gearbeitet.
Wenn es darum geht sich aus der Verantwortung zu drücken, dann spannen die Goliaths zusammen und strecken den armen David nieder.
